1. Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of Tune-Up Golf™, including Tune-Up Golf websites, account areas, applications, tools, forms, communications, golf-game features, recurring groups, tournament services, golf instructor listings, golf-course information, Updates & Photos, and related services.
Tune-Up Golf™ is owned and operated by Express One Industries (“Tune-Up Golf,” “we,” “us,” or “our”).
By accessing or using Tune-Up Golf, you agree to these Terms. If you do not agree, you should not use the platform.
2. Eligibility
Tune-Up Golf is intended for users who are at least 18 years old. By creating an account or using account-based features, you represent that you are at least 18.
3. Tune-Up Golf Is a Technology and Community Platform
Tune-Up Golf provides tools intended to help golfers find games, organize games and recurring groups, manage tournaments, communicate with participants, locate golf instructors, discover golf courses, and manage related golf activity.
Unless expressly stated otherwise, Tune-Up Golf is not the golf course, game organizer, tournament operator, golf instructor, sponsor, equipment provider, transportation provider, payment recipient, or other independent third party involved in an activity arranged through the platform.
4. Accounts and Account Security
Certain Tune-Up Golf features require an account. You are responsible for providing accurate information and maintaining the security of your login credentials.
You are responsible for activity occurring through your account unless applicable law provides otherwise.
You should promptly notify Tune-Up Golf if you believe your account has been accessed without authorization.
5. Golf Games and Recurring Groups
Tune-Up Golf may allow organizers to create one-time games and recurring golf groups, invite golfers, collect RSVPs, manage player limits, organize accepted golfers, send reminders, and publish final game information.
Tee-Time Reservations
Tune-Up Golf does not book or reserve golf-course tee times. The organizer is responsible for reserving the tee time or tee times directly with the applicable golf course or pro shop before posting those reserved times inside Tune-Up Golf.
Tune-Up Golf is not responsible for a golf course changing, cancelling, modifying, or refusing a reservation.
Player Preferences
Golfers may be permitted to request a preferred reserved tee time or another golfer they would like to play with. These are requests only and are not guaranteed.
The organizer controls the final player-group assignments for ordinary golf games.
Group Sizes
Tune-Up Golf does not assume that every golf group consists of four players. Golf courses and organizers may use threesomes, foursomes, fivesomes, or other group sizes where permitted.
6. Recurring Group Membership
Recurring golf groups may maintain an ongoing member list separate from participation in any particular week’s game.
A golfer may remain an active member of a recurring group even when they decline or do not participate in a specific outing.
The applicable organizer may add or remove members according to available Tune-Up Golf controls.
Removal from a recurring group may also terminate the removed user’s future access to private group features, including the group’s private Updates & Photos feed.
7. Find a Game
Tune-Up Golf may allow organizers to make certain games discoverable to other users through Find a Game.
A request to join does not guarantee acceptance, a playing position, a reserved tee time, or participation in the game.
The applicable organizer decides whether to accept or decline a request to join unless Tune-Up Golf expressly provides otherwise.
8. Golf Tournaments
Tune-Up Golf may provide tools for charity, club, member, corporate, private, and other golf tournaments.
Tournament tools may include registration, payment tracking, preferred player groups, sponsors, contests, meals, communications, Updates & Photos, and golf-course grouping exports.
Tournament organizers are responsible for their event information, registration rules, pricing, refunds, participant eligibility, payment arrangements, sponsors, contests, food and beverage information, event-specific rules, and communications.
Golf-Course Authority
For tournaments, an organizer may create preferred player groups, preferred group order, and A/B or similar grouping information.
The applicable golf course or pro shop retains final authority over actual tee times, shotgun starting holes, course assignments, cart assignments, and other golf-course operational decisions.
9. Tournament Sponsorships
Tournament organizers may create sponsorship opportunities and share tournament-specific sponsorship pages or links.
The organizer is responsible for defining sponsorship levels, prices, benefits, complimentary golf spots, payment instructions, sponsor recognition, refund terms, and any sponsor agreement.
Unless Tune-Up Golf expressly states otherwise, payments made directly to an organizer by Zelle, Venmo, check, cash, or another method are transactions between the sponsor and organizer.
10. Golf Instructors
Golf instructors appearing on Tune-Up Golf are independent third parties unless expressly stated otherwise.
Tune-Up Golf does not guarantee or independently verify an instructor’s qualifications, certifications, experience, services, prices, availability, performance, safety, or results.
Users should independently evaluate an instructor before purchasing or participating in instruction.
Instructor listings may include basic, claimed, verified, paid, featured, or other profile types as Tune-Up Golf develops its services.
11. Golf Courses and Directory Information
Tune-Up Golf may maintain golf-course, instructor, business, sponsor, and other directory information.
Information may come from publicly available sources, seed databases, user submissions, business submissions, or other sources.
Tune-Up Golf does not guarantee that every listing is complete, current, accurate, or error-free.
Logged-in organizers may be permitted to add a genuinely missing golf course while creating a game or tournament. Tune-Up Golf may later review, correct, merge, update, or remove that record.
12. Updates & Photos
Tune-Up Golf may provide Updates & Photos feeds connected to one-time games, recurring golf groups, tournaments, or other Tune-Up Golf activities.
These feeds may contain:
- Announcements
- Game and tournament updates
- Results and winner information
- Skins or contest results
- Photographs
- Captions
- Comments
- Sponsor recognition
- Other user-generated content
One-Time Games
Content associated with a one-time game may remain tied to that particular outing and does not automatically become part of a recurring group’s permanent feed.
Recurring Groups
A recurring golf group may maintain an ongoing feed. Active group members may continue to access the private group feed even when they are not participating in a particular week’s game.
Tournaments
Tournament feeds may contain event updates, results, photos, sponsor recognition, contest results, winner information, and other tournament-related content.
13. Ownership of User Content
As between you and Tune-Up Golf, you retain ownership of original content you submit or upload to Tune-Up Golf, subject to any rights owned by other parties.
Tune-Up Golf does not claim ownership of your original photographs, comments, posts, or other original user content merely because you upload them to the platform.
14. License to Use User Content
By submitting or uploading content to Tune-Up Golf, you grant Tune-Up Golf and Express One Industries a non-exclusive, worldwide, royalty-free license to host, store, copy, reproduce, display, format, transmit, distribute, and otherwise use that content as reasonably necessary to operate, provide, secure, improve, and administer the Tune-Up Golf platform.
This license includes displaying your content to users who are authorized to view the applicable game, recurring group, tournament, profile, or other platform area.
If you or an authorized organizer designates content as public, the license also includes displaying that content through public Tune-Up Golf features, including the Tune-Up Golf Blog, public tournament pages, or other public platform areas.
This license does not transfer ownership of your original content to Tune-Up Golf.
15. Your Responsibility for Uploaded Content
You are responsible for content you submit. You represent that you have the rights, permissions, or authority necessary to upload and share that content through Tune-Up Golf.
You should not upload content that:
- Infringes another person’s copyright, trademark, privacy, publicity, or other rights
- Contains unlawful material
- Contains threats or harassment
- Is fraudulent, deceptive, or misleading
- Contains malicious software or harmful code
- Violates another person’s reasonable privacy
- Contains content you do not have permission to share
- Violates these Terms or another Tune-Up Golf policy
Users should consider the privacy and rights of people appearing in photographs before uploading or publicly sharing those photos.
16. Organizer Moderation
Organizers may have moderation controls for content associated with games, recurring groups, and tournaments they manage.
Available organizer controls may include:
- Approving or restricting member posting
- Removing or hiding posts
- Removing photographs
- Changing permitted visibility settings
- Downloading photographs associated with the group or event
- Reporting inappropriate content
- Managing public or private visibility
Organizer moderation does not make the organizer an employee or agent of Tune-Up Golf.
17. Removal of User Content
Where available, users may remove their own posts or photographs.
Tune-Up Golf may remove, restrict, disable access to, or refuse to display content if we reasonably believe the content:
- Violates these Terms
- Violates applicable law
- Infringes third-party rights
- Creates safety or security concerns
- Is abusive, deceptive, fraudulent, or harmful
- Creates platform or operational risk
- Is otherwise inappropriate for Tune-Up Golf
Removal from active display does not necessarily mean that every technical copy is immediately deleted from backups, security records, audit logs, or systems where temporary retention is reasonably necessary or legally permitted.
18. Public Content and Sharing
Some Tune-Up Golf content may be designated public. Public information may be viewed by people who are not members of the applicable group or event.
Public content may be copied, downloaded, indexed, shared, reposted, or otherwise retained by third parties outside Tune-Up Golf’s control.
Users should not make content public if they do not want it widely visible.
19. Messaging and Communications
Tune-Up Golf may provide email, SMS, account notifications, or other communications in connection with:
- Game invitations
- RSVPs
- Reserved tee-time assignments
- Game reminders
- Tournament communications
- Instructor inquiries
- Billing
- Account security
- Support
- Permitted marketing
Use of SMS services is also governed by the SMS Terms & Consent.
20. Organizer Messaging Responsibilities
Organizers and other users may not use Tune-Up Golf to send unlawful, fraudulent, harassing, deceptive, abusive, or unauthorized communications.
Where applicable, organizers are responsible for complying with laws and consent requirements related to communications they initiate.
21. Payments, Billing, and Paid Features
Tune-Up Golf may offer paid memberships, organizer features, game credits, tournament services, featured instructor profiles, advertising, sponsorship-related tools, or other paid products.
Specific pricing, billing, renewal, cancellation, refund, and payment terms may be provided when a paid feature is purchased.
Third-party payment processors may have their own terms and privacy policies.
22. Refunds and Third-Party Payments
Payments made directly to an organizer, instructor, sponsor, golf course, or other independent third party are subject to the terms established between those parties.
Tune-Up Golf is not responsible for refunds involving money that Tune-Up Golf did not receive unless expressly stated otherwise.
23. Prohibited Uses
You may not use Tune-Up Golf to:
- Violate applicable law
- Impersonate another person or organization
- Harass or threaten another user
- Send spam or unauthorized marketing
- Upload malware or harmful software
- Attempt unauthorized access to accounts or systems
- Scrape or harvest information in violation of law or platform restrictions
- Misrepresent golf games, tournaments, instructors, businesses, or sponsorships
- Manipulate account, billing, or participation systems
- Interfere with the operation or security of the platform
- Use Tune-Up Golf for unlawful or fraudulent activity
24. Suspension or Termination
Tune-Up Golf may suspend, restrict, or terminate access to some or all platform features when reasonably necessary to:
- Enforce these Terms
- Protect users or Tune-Up Golf
- Address fraud or abuse
- Comply with legal requirements
- Protect platform security
- Respond to nonpayment where applicable
25. Third-Party Services and Links
Tune-Up Golf may contain links, integrations, information, or services involving independent third parties, including golf courses, golf instructors, payment providers, Amazon, golf organizations, and other businesses.
Tune-Up Golf is not responsible for third-party websites, services, availability, privacy practices, security, products, or conduct.
26. Amazon and Affiliate Relationships
Tune-Up Golf may display affiliate links or product recommendations.
As an Amazon Associate, Tune-Up Golf may earn from qualifying purchases.
Affiliate relationships do not necessarily mean Tune-Up Golf endorses or guarantees a third-party product.
27. No Guarantee of Participation or Availability
Tune-Up Golf does not guarantee:
- Acceptance into a golf game
- Availability of a particular reserved tee time
- Availability of a golf course
- Availability of tournament space
- Availability of an instructor
- Delivery of every message
- Accuracy of every third-party listing
- Successful completion of a game or tournament
28. Golf and Activity Risks
Golf and related activities involve risks including personal injury, property damage, weather, travel, equipment use, course conditions, and interactions with other individuals.
Users participate in golf activities at their own risk and should follow applicable golf-course rules, safety requirements, and reasonable precautions.
29. Disclaimers
To the fullest extent permitted by law, Tune-Up Golf is provided on an “as is” and “as available” basis.
Tune-Up Golf does not make warranties that the platform will be uninterrupted, error-free, secure, or suitable for every user’s purpose.
Tune-Up Golf does not independently guarantee, endorse, or warrant third-party games, tournaments, golf courses, instructors, sponsors, products, services, information, availability, qualifications, performance, or results.
30. Limitation of Liability
To the fullest extent permitted by law, Tune-Up Golf, Express One Industries, and their respective affiliates, officers, directors, employees, agents, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the platform.
Tune-Up Golf is not responsible for independent third-party conduct, golf-course decisions, organizer actions, participant conduct, tournament operations, instructor services, sponsor disputes, reservation issues, cancellations, injuries, property damage, lost content, or other third-party activities, except where liability cannot legally be excluded.
31. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tune-Up Golf, Express One Industries, and their respective affiliates, officers, directors, employees, agents, and representatives from claims, liabilities, damages, losses, and expenses arising from your misuse of Tune-Up Golf, your violation of these Terms, your violation of another person’s rights, or content you submit.
32. Intellectual Property
Tune-Up Golf™, Tune-Up Golf branding, logos, visual designs, software, platform features, page designs, and other proprietary materials belong to Express One Industries or their applicable licensors, except for third-party materials and user-owned content.
These Terms do not grant users ownership of Tune-Up Golf intellectual property.
33. Third-Party Trademarks
Tune-Up Golf is not affiliated with, endorsed by, or sponsored by the United States Golf Association (USGA), The R&A, GHIN, PGA of America, PGA TOUR, LPGA, or any golf organization, golf course, country club, equipment manufacturer, brand, or other third party unless expressly stated.
All third-party names, logos, trademarks, product names, and service marks belong to their respective owners.
34. Privacy
Tune-Up Golf’s collection and use of personal information is described in the Privacy Policy.
35. Changes to the Platform
Tune-Up Golf may add, modify, suspend, or discontinue features at any time.
Features described on the website may be in development and may change before or after launch.
36. Changes to These Terms
Tune-Up Golf may update these Terms from time to time. The “Last Updated” date will identify the most recent revision.
Where required, material changes may also be communicated through the website, account area, email, or another appropriate method.
37. Governing Law
Unless applicable law requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
38. Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
39. No Waiver
Failure by Tune-Up Golf to enforce a provision of these Terms does not waive our right to enforce that provision later.
